Colorado Privacy Act (CPA) and BentoBox

What is the Colorado Privacy Act? 

The Colorado Privacy Act (CPA) mirrors the California Consumer Privacy Act (CCPA) with a couple of differences. Colorado’s CPA does not apply to (1) data collected in the context of business interactions or (2) data of employees, applicants and their beneficiaries. The CPA applies to “controllers” that conduct business or produce commercial products or services that are intentionally targeted to “consumers” and that either:

  1. Control or process “personal data” of at least 100,000 “consumers” per calendar year; or

  2. Derive revenue from the “sale” of “personal data” and control or process the personal data of at least 25,000 “consumers.”

Considerations: 

BentoBox does not sell customer's personal information. Any website that’s powered by BentoBox uses cookies and other tracking tools to analyze website traffic and the facilitation of order information.  

BentoBox honors customer requests to delete personal information. You may request to correct, amend, or delete the personal information hold about your diners by contacting privacy@getbento.com.

BentoBox customers have the flexibility to edit or customize their diner privacy policy to suit their preferences & data use as you might be using other platforms where customer data is held. 

Customers are encourage to enable the following privacy settings under their website’s General Settings page:

  1. Add a privacy policy 

  2. Display Cookie Consent form

BentoBox has prepared a privacy policy that explains our platform’s collection, use, and disclosure of consumer personal information. We are working on updating this policy to ensure it accommodates all state-specific regulations. 

You may choose to display this policy on your BentoBox-powered website. Customers that provide their own privacy policy should not include any description of personal information collection, use or disclosure that is inconsistent with or that limits BentoBox’s ability to provide the services.
